1. About Formula D1

Formula D1 provides tools to help student-athletes research college athletic programs, organize recruiting opportunities, generate outreach messages, and communicate with college coaches.

Formula D1 is an independent recruiting technology platform and is not affiliated with or endorsed by the NCAA, any athletic conference, or any college unless expressly stated.

2. Eligibility

You must be at least 13 years old to create or use a Formula D1 account.

If you are under 18, you must have permission from a parent or legal guardian to use the service, and your parent or guardian must agree to these Terms on your behalf to the extent required by applicable law.

You agree to provide accurate account information and maintain the security of your login credentials.

3. Accounts and Acceptable Use

You are responsible for activities conducted through your account.

You agree not to:

• Access accounts or information without authorization
• Scrape, harvest, systematically extract, or resell coach contact information or other platform data
• Circumvent subscription restrictions, usage limits, or security controls
• Send unlawful, deceptive, harassing, or otherwise prohibited communications
• Use automated systems to abuse platform features
• Interfere with platform operation or security
• Misrepresent your identity or athletic qualifications

We may restrict or suspend accounts that violate these Terms, subject to applicable law.

4. Recruiting Tools and Communications

Formula D1 provides recruiting information and communication tools for informational and organizational purposes.

You are responsible for reviewing your messages and determining whether to send them.

When using connected Gmail functionality, you authorize the platform to facilitate the messages you approve through your connected account.

You agree to comply with applicable email and communication laws, Google policies, and relevant college recruiting rules.

Coach information, school information, recommendations, and contact details may change or contain inaccuracies.

5. No Recruiting Guarantee

Formula D1 does not guarantee:

• A college scholarship or athletic offer
• A response from any coach
• Admission to a college or university
• Recruitment by any athletic program
• Accuracy or continued availability of any particular coach contact

Recruiting outcomes depend on numerous factors outside Formula D1's control.

6. Subscription Pricing and Automatic Renewal

Formula D1 offers free and paid access, subject to the features and limitations displayed on the platform.

The current All Access subscription is $349.99 per year, unless a different price or promotion is clearly disclosed at purchase.

The paid subscription automatically renews annually until canceled.

By purchasing, you authorize recurring charges to your selected payment method at the disclosed subscription price and billing frequency, including applicable taxes.

We will provide legally required disclosures, acknowledgments, and renewal notices.

Any price changes will be communicated and implemented according to applicable law.

7. Cancellation

You may cancel your subscription through the cancellation method provided in your account. In the Formula D1 app, go to Profile, then Account, then Subscription & Billing, and select Manage Subscription, which opens the billing portal.

If that option is unavailable to you, email jack@acquisitionenterprises.net and we will help you cancel.

Unless otherwise stated at purchase or required by law, cancellation stops future renewals and paid access continues through the current paid billing period.

Cancellation does not automatically refund a completed charge. Refund eligibility is governed by the Refund Policy below and applicable law.

We will not impose unreasonable barriers to cancellation.

8. 14-Day Money-Back Guarantee

Every new Formula D1 All Access subscription includes a 14-day money-back guarantee.

To qualify for a full refund:

1. You must request it within 14 calendar days of your initial purchase.
2. You must have sent no more than 50 emails through Formula D1.

How to request a refund

Email support@formulad1.com within the 14-day period and include your Formula D1 account email.

Eligible refunds are returned to the original payment method.

Cancellations

• You can cancel your subscription anytime to prevent future annual renewals.
• Canceling does not automatically issue a refund.
• Paid access continues through the current billing period unless refunded or otherwise terminated.

Nothing in these Terms limits refund or cancellation rights that cannot legally be waived.

9. Payments

Payments are processed by Stripe or another disclosed payment provider.

You agree to provide valid payment information and authorize charges associated with your selected subscription.

We may suspend paid features if a payment fails, subject to applicable law.

10. Intellectual Property

Formula D1's software, design, branding, content, and proprietary technology are owned by Formula D1 or its licensors and are protected by applicable intellectual property laws.

We grant you a limited, personal, nonexclusive, nontransferable right to use the platform according to these Terms.

You may not reproduce, distribute, resell, or reverse engineer protected platform materials except as permitted by law.

You retain ownership of information and content you submit, subject to the limited permissions necessary for us to operate the service.

11. Third-Party Services

Formula D1 may integrate with Google, Stripe, and other third-party providers.

Those providers may have separate terms and privacy policies.

We are not responsible for third-party service interruptions or independent changes to their products, except as required by law.

12. Privacy

Your use of Formula D1 is also governed by our Privacy Policy, available at https://formulad1.com/privacy.

13. Service Availability and Changes

We may update, maintain, or modify the platform to improve functionality, security, or performance.

We do not guarantee uninterrupted service.

Material changes affecting paid subscriptions will be handled according to applicable law.

14. Disclaimers

To the extent permitted by applicable law, Formula D1 is provided on an "as available" basis without warranties that recruiting results, communications, or platform information will meet every user's expectations.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

15. Limitation of Liability

To the extent permitted by applicable law, Formula D1 and its operators are not liable for indirect, incidental, special, or consequential damages arising from use of the platform.

Any limitation of liability is subject to applicable consumer-protection laws and other nonwaivable rights.

16. Termination

You may stop using Formula D1 at any time.

We may suspend or terminate access for material violations of these Terms, fraud, security threats, or other lawful reasons.

Termination does not eliminate accrued payment obligations or legally protected refund rights.

17. Governing Law

These Terms are governed by the laws of the State of Connecticut, subject to mandatory consumer protections and applicable law.

18. Changes to Terms

We may revise these Terms periodically.

We will publish updated Terms with a revised effective date and provide additional notice or obtain consent where required.
